These terms are an agreement between you and Brainclinics Heart-Brain Group B.V., Bijleveldsingel 32, 6524 AD Nijmegen, The Netherlands (KvK 94388784, VAT NL866759529B01, info@brainclinics.com), referred to as "we". They apply to the Heart-Brain Connect® Live software, the website heartbrainconnect.com and your account (together, the "Service"). By creating an account or using the software you accept these terms.
Heart-Brain Connect Live is a desktop application for Mac and Windows that shows your heart rate and Heart-Brain Coupling (HBC) in real time from a Polar H10 chest strap, to support relaxation and paced-breathing practice. The chest strap is not included.
The software is a general wellness product. It is not a medical device and is not intended to diagnose, treat, cure or prevent any disease, or to replace advice from a healthcare professional. The ECG trace is shown for feedback only and is not suitable for diagnostic interpretation. Slow or deep breathing can cause light-headedness; stop if you feel unwell. You must be 18 or older to use the Service.
Keep your login details confidential; you are responsible for activity under your account. One account is for one person and may be used on up to two computers at a time; you can see and remove your computers on your account page. Give us accurate information and keep your e-mail address up to date.
Access requires an active subscription (monthly or annual) or a valid coupon licence. New subscriptions start with a free trial of 7 days; you can cancel during the trial at no cost, and the first payment is taken when the trial ends. Prices are shown on the pricing page in euros excluding VAT; VAT is added at checkout where applicable. Payments are processed by Stripe; we do not store your card details. Subscriptions renew automatically at the end of each period until you cancel. You can cancel at any time from your account page; cancellation takes effect at the end of the current period, and no refund is made for the remaining time except as described in section 5. We may change prices with at least 30 days' notice by e-mail; a change applies from your next renewal. Coupon codes are single-use, non-transferable and have no cash value.
If you are a consumer, you may withdraw from your first purchase within 14 days without giving a reason by e-mailing info@brainclinics.com. Because the licence is activated immediately at your request, we refund the amount paid minus a proportional amount for the days already used.
We grant you a personal, non-exclusive, non-transferable licence to install and use the software for as long as your subscription or coupon licence is valid. You may not copy, sell, rent, sublicense or redistribute the software, remove any notices, or reverse engineer, decompile or disassemble it, except to the extent the law expressly permits. The software, the methods it implements, all related materials and the name Heart-Brain Connect® are our property or that of our licensors.
Recordings and reports are stored on your own computer, not on our servers; you are responsible for backing them up. The software contacts our server to verify your licence (it keeps working offline for up to 48 hours between checks) and sends basic usage statistics as described in our Privacy Policy. No heart-rate or ECG data is ever sent to us.
We may update the software and the Service, and may require you to install an update to keep using it. We aim for reliable availability but do not guarantee that the Service will be uninterrupted or error-free. Bluetooth performance depends on your computer and environment.
Nothing in these terms limits liability that cannot be limited by law, including liability for intent or gross negligence. Otherwise, our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim, and we are not liable for indirect damage such as lost data, lost profit or business interruption.
You may end this agreement at any time by cancelling your subscription and deleting your account. We may suspend or end your access if you materially breach these terms, for example by sharing your account or tampering with the software, after giving notice where reasonable.
We may change these terms. We will notify you by e-mail at least 30 days before a material change takes effect; if you do not agree, you can cancel before it applies.
Dutch law applies. Disputes are brought before the competent court in Gelderland, the Netherlands, without prejudice to mandatory consumer protection rules of your country of residence.
